Exceptions of Labor Time for Student Visa
Did you know the fact that student visa permits work time for 28 hours per week?
There are exceptions behind.
Beforehand, let’s remind you that you are allowed to come Japan because you have a students visa with you. The purpose is studying rather than working. You have to keep in mind that you do part time after received the permission to engage in activity that that permitted under the status of residence previously granted and don’t interfere with your academics.
Hence, there’re cases which the work time is eased its restriction such as summer and spring breaks. Golden Week and New Year’s Holiday is not included. The term of long breaks are fixed depends on school’s principles. Therefore, you should ask to the school first. During the long breaks, you are able to work eight hours per day same as Japanese students.
Forty work hours per week does not mean you are allowed to work 8 hours × 5 days=40 hours. You are permitted to work 8 hours per day and not 40 hours per week. In other words, you can’t work 10 hours per day even though your work is within 40 hours per week.
There are companies which they don’t know about this regulation. You should remind he manager about it according to the points below.
① The 28 work withdrawal is during school long breaks.
②The terms and conditions are same as Japanese workers during long breaks.
③ You are able to work 8 hours per day even though you have multiple part time jobs.
The immigration manage the permission to engage in activity. When you change your visa status from student to working, you have to hand in tax certificate which can be defined your over work time and monthly salary.
Although you received the job offer from Japanese companies, it’s difficult situation to proceed the change of residence status in the immigration and can no longer stay in Japan at last.
